Judiciary Hearing with Alberto Gonzales
CNN -YouTube - posted by Nancy Pelosi May 10

What follows is a selection from the transcript of the Congressman
Davis’ courageous and strident questioning of Gonzales in the House
Judiciary Committee regarding one of the legal anomalies in the
"Alabama Case".
...........................................................................................................
Congressman Davis (D) Alabama:

"Let me turn to the Alabama Case.  The former Governor of
Alabama who was indicted…Dismissed by the first District
Judge before the case went to trial on the grounds of
insufficient facts.  The second case – a 34 count indictment 32
counts dismissed.  Evidence of juror misconduct based on
emails that were obtained – the US Attorney’s office that
prosecuted the case declined to investigate juror misconduct
and indeed sought to exclude the emails from even being
heard in an evidentiary hearing.  Here is the question:  Would
you expect a US Attorney office that had evidence of jury
misconduct to investigate the misconduct or exclude it from
being heard at evidentiary hearing?  Which is the better
    practice, Mr. Gonzalez? "

US Attorney  General Gonzalez:

"As a general matter, the former. But I'm not going to comment
on this particular case without looking at the facts."

Justice Not Yet Served

And how does one reconcile jurors e-mailing other jurors during the
trial, contrary to the trial judge's express instructions? That alone
should entitle Scrushy and Siegelman to a new trial. Surely the 11th
Circuit Court of Appeals in Atlanta cannot allow such a gross abuse
of the jury system to remain as a precedent.

This was not mere harmless error. One e-mail dated June 25, 2006,
at 10:41 p.m. stated "Gov and pastor (Scrushy's nickname) up s--t
creek, all public officials are scum; especially this one; pastor is really
a piece of work...they missed before, but we won't...also keep
working on (another juror)."

Many believe the federal prosecution against Scrushy [and
Siegelman] in Montgomery was motivated by the stinging defeat the
U.S. attorneys suffered with Scrushy [and Siegelman] in Birmingham
during their six-month-long prosecution of him in 2005.
