4/14/07 GOVERNMENT’S MOTION IN LIMINE TO BAR DEFENDANTS FROM PRESENTING TESTIMONY, EVIDENCE, OR ARGUMENT CONCERNING ALLEGED POLITICAL MOTIVATION FOR THE PROSECUTION

MOTION:...moves this Court for an Order precluding the defendants, counsel for the
defendants, and defendants’ witnesses from mentioning, referencing, introducing,
offering, or attempting to introduce or offer any evidence, testimony, or argument that
politics was a motivating factor in the government’s decision to prosecute the
defendants. As grounds for this motion, the United States submits that recent filings
by the defendants indicate that they, in particular Defendant Siegelman, intend to
improperly interject politics into the trial of this public corruption case. For the
reasons stated herein, the government anticipates that Defendant Siegelman plans
to present testimony, evidence, or argument to the effect that this case is the product

It is a fact: The Presiding judge, a Bush appointee, refuses to investigate juror
misconduct. Eight emails have surfaced post conviction which if authenticated by the
judge would require a new trial. The judge has refused to investigate the emails.

It is a fact: The judge is a substantial stockholder (40%) in Doss Aviation Company
which was notified of a possible contract award from the United States Government
in February, 2006 after Judge Fuller took this case and on May, 2006 during jury
deliberations Doss Aviation was awarded a $178 Million Dollar contact renewable
annually by the United States. The Judge is listed as the registered agent and the
Federal Court House address is used as the address of the Registered Agent for
Doss Aviation.
