What follows is the transcript of the Congressman Davis’ courageous and strident
questioning of Gonzales in the House Judiciary Committee regarding just one of
the legal anomalies in the Alabama Case.
Congressman Davis (D) Alabama: "Let me turn to the Alabama Case. The
former Governor of Alabama who was indicted…Dismissed by the first District
Judge before the case went to trial on the grounds of insufficient facts. The
second case – a 34 count indictment 32 counts dismissed. Evidence of juror
misconduct based on emails that were obtained – the US Attorney’s
office that prosecuted the case declined to investigate juror
misconduct and indeed sought to exclude the emails from even
being heard in an evidentiary hearing. Here is the question: Would
you expect a US Attorney office that had evidence of jury misconduct
to investigate the misconduct or exclude it from being heard at
evidentiary hearing? Which is the better practice, Mr. Gonzalez? "
US Attorney General Gonzalez: "As a general matter, the former. But I'm
not going to comment on this particular case without looking at the facts."

Troubling Questions
Riley Attacked Siegelman For ‘Corruption’. “A second GOP gubernatorial
candidate, U.S. Rep. Bob Riley, R-Ashland, also slammed the governor. ‘They
say “Where there is smoke, there is fire,” and our state government is choking
on a lot of smoke right now,’ Riley said in a written statement. ‘Like all
Alabamians, I'm tired of all the scandals and embarrassing things our state
leaders do from time to time. It's time to clean that place up.’” [MR, Owen,
2/12/02]
Riley Made Ethics Central Issue In Campaign. “U.S. Rep. Bob Riley, another
Republican seeking Siegelman’s job, has started television commercials that
do not mention Siegelman by name but mention the climate in the capital. ‘As
governor I’ll clean up Montgomery and end the corruption,’ Riley said,
mentioning ‘sweetheart’ no-bid contracts.” [TN, Beyerle, 2/12/02]
Windom Ran Political Ads On Corruption. Windom ran a political advertisement
that attacked Siegelman for corruption. The ad said, “Newspapers condemn
Don Siegelman’s no-bid state contracts to campaign contributors Siegelman’s

Open Ended Investigation Started After Warehouse Project;
Siegelman Not Accused Of Any Wrongdoing In Project
Republican Attorney General Started Investigation At Request Of Siegelman’s
Political Opponents.
According to the Mobile Register, “Attorney General Bill Pryor said Tuesday that
he has opened an investigation into the handling of a state project involving the
construction of two warehouses in Montgomery. Lt. Gov. Steve Windom, who is
considering a run for governor in 2002, was among those calling upon Pryor, a
fellow Republican, to look at the warehouse deal. ‘We've received several
requests to open an investigation into the matter of G.H., or Goat Hill,
Construction,’ Pryor said.” [MR, Amy, 5/2/01]
