....There are serious questions for appeal in the Siegelman-Scrushy
case, including whether a crime was committed at all, whether it was
proper for jurors to e-mail each other outside the jury room, and
whether a fair and impartial judge presided at the case.
Siegelman and Scrushy have been especially prejudiced by the court
reporter's death, requiring a new court reporter to take up to two
years after the convictions before an appellate transcript is ready.
How can Siegelman and Scrushy ever "unserve" the six months they
have already spent languishing away in prison, removed from wife
and family and deprived of Thanksgiving and Christmas at home? Of
course, they'll never recapture this time and they will have been
wrongfully punished if their convictions are reversed.
