Judge ordered to rule on Siegelman bid to be
freed

MONTGOMERY - A federal appeals court has told U.S. District Judge
Mark Fuller of Montgomery to promptly rule on former Gov. Don
Siegelman's request that he be released from prison while he
appeals convictions on bribery and other charges.
The 11th U.S. Circuit Court of Appeals said Fuller should consider
and rule on Siegelman's request in an "expeditious" manner, and that
Fuller's order "should explain the reasons" for whatever he decides.
The appeals court in Atlanta issued its order Thursday. The district
court in Montgomery received it Friday.

..."We've got a governor who is in jail," said Vince Kilborn, a Mobile
attorney who represented Siegelman during his 2006 trial and
sentencing hearing earlier this year. "And we have the 11th Trial
Circuit telling them to look at this ... issue before we decide it. In other
words, (they say) 'We're giving you the first shot. We don't think it
was done correctly the first time."
Assistant U.S. Attorneys Louis Franklin and Stephen Feaga, who
prosecuted Siegelman, downplayed the court's ruling.
"There's nothing unusual about the 11th Circuit asking a district
judge for additional information," Feaga said. "It's just a routine and
normal matter."
